A Massachusetts Medical Power of Attorney Form is designed to give the Attorney-in-Fact the power to make decisions about the Principal’s medical treatments and health care. In Massachusetts these agreements are always durable are legally known as a Health Care Proxy form. They will also usually be Springing, and will thus only go into effect after the Principal has been declared incapacitated.
Under Massachusetts state law, a Living Will (legally known as a Document Directing Health Care) is a separate document from a Health Care Proxy. While the Principal may wish to lay out separate wishes regarding their End of Life care and arrangements, they may also wish to write and draft those two documents together, as it may effect what decisions an Attorney-in-Fact can make.
