The Maryland Medical Power of Attorney Form is used to give the Agent the power to make decisions about the Principal’s health care or medical treatments. As these kinds of agreements are governed separately from all other Power of Attorney agreements, this is the only kind of agreement that can give an Agent this power.

In Maryland a Medical Power of Attorney Agreement will always include a Living Will, with the combined form being known legally as an Advance Directive. When the Principal drafts their Medical Power of Attorney form, they should ensure that their wishes for End of Life care are included, and that they trust the Agent named in the Power of Attorney Agreement to enact those wishes.
