A Maine Medical Power of Attorney Form is used to give the Attorney-in-Fact power to make decisions about the Principal’s medical treatment. These agreements are always Durable, meaning they will continue working after the Principal has been incapacitated and almost always Springing, meaning they will take effect only once the Principal has been declared incapable of making their own decisions.

In Maine, a Medical Power of Attorney Agreement will always include a Living Will (the combined document is legally known as an Advance Health Care Directive). Therefore, when drafting a Medical Power of Attorney Form, the Principal should ensure the Attorney-in-Fact is aware of their desires for End of Life care, or should make such desires clear in the agreement itself.
