A North Dakota Medical Power of Attorney Form is used when the Principal wants the Attorney-in-Fact to make decisions about the Principal’s health care. This is the only agreement that can give the Principal this power, as Medical Power of Attorney agreements are governed separately from all other Power of Attorney forms.

Note that, under North Dakota state law, all Medical Power of Attorney agreements will include a Living Will. The combined document is referred to as a Health Care Directive. Therefore, when drafting a Medical Power of Attorney agreement, a Principal should also ensure that their wishes regarding their End of Life care and funeral arrangements are clear, as the Principal will be responsible for that as well.
