The New Mexico Medical Power of Attorney Form is used to give the Agent authority over the Principal’s medical treatment and health care. These kinds of agreements are typically Springing and essentially always Durable, as otherwise they would be useless; An Agent will usually only need to make decisions about the Principal’s medical care when the Principal is unable to.

Note that, under Mexico state law, a Medical Power of Attorney Agreement (also known as an Advance Health Care Directive) will always include instructions for a Living Will. As such a Principal should make sure they include instructions about their End of Life care in their Medical Power of Attorney agreement, as any Agent they name in such an agreement will be responsible for both.
