A New York Medical Power of Attorney Form is used to give the Attorney-in-Fact authority to make decisions about the Principal’s health care and medical treatments. It is the only kind of agreement that can do this, as Medical Power of Attorney agreements are governed differently from all other Power of Attorney agreements and thus must be drafted separately.

In New York, a Medical Power of Attorney agreement, or Health Care Proxy, does not include a Living Will or Document Directing Health Care. If the Principal wants their Attorney-in-Fact to have the power to manage their End of Life care, in addition to Medical Treatments, they will need to also draft a Living Will.
