A West Virginia Medical Power of Attorney is designed to give the Attorney-in-Fact the power to make decisions about the Principal’s health care and medical treatments. This kind of agreement is always Durable and Springing, as they are only really of use when the Principal is no longer capable of making or communicating their wishes regarding their health care.

Unlike in some states, in West Virginia, a Medical Power of Attorney agreement is a completely separate document from a Living Will. As an Attorney-in-Fact in charge of health care will often be placed in the role of having to make decisions about the Principal’s End of Life care, it is generally recommended that the Principal draft a Living Will alongside their Medical Power of Attorney.
