A room rental agreement most often occurs in the form of a sublease – when one person who rents an apartment rents a portion of that apartment, such as a second bedroom, to another individual. Sometimes, however, this document could be signed between a home owner and a person who rents space from them, or between a company and a renter taking on a short-term rental room, such as an extended stay hotel.
Room Rental Agreements and Subleases
In most states, landlords do not have to review or sign subleases or room rental agreements, but they do have to know if a renter is subleasing space to another tenant. This is because there can be safety issues with specific numbers of people in a home or apartment – if the number goes over the state safety limits, then that could be considered a fire hazard or health hazard, leading to the entire group being evicted from the rental property.
Room rental agreements that do not involve subleases sometimes involve caretakers moving into a home with a person who needs care. Nannies or professional caregivers for the elderly or disabled can, in many places, move into a spare room in order to provide 24/7 care to the needy individual or family. This can provide a lot of peace of mind for other family members who may not be available to take care of the elderly or disabled individual, or in the case of single parents or two working parents.
Boarding houses and extended stay hotels offer something more formal than a room rental agreement, but the document works much the same way. The managers either own or lease the property and provide a contract more easily broken than a true lease or rental agreement. A room rental agreement form allows the company to list rules, regulations, and reasons for eviction to a potential tenant through a legal document that is, at the same time, less legally binding than a rental agreement.
In the case of sublease-style room rental agreements, the original renter agrees with the landlord to take on the financial risk of the subleasing tenant. The tenant and subleaser may come to an agreement regarding slightly higher rent to cover damages to the property which might otherwise come out of the original tenant’s deposit. Or, the original tenant will request payment for damages out of the subleaser’s pocket.
Why Use a Room Rental Agreement Template?
Room rental agreements provide a little more flexibility in most states than lease or other rental agreements, but the document is still legally binding. These agreements can flexibly specify how fees beyond the rent are paid, including utilities, shared internet or television, security deposit, damages, and even a split on groceries or other necessities.
A room rental agreement can also be a formal document between two roommates who both sign the lease with the landlord.
