A Delaware Medical (Advance Health Care Directive) Power of Attorney Form is an agreement that gives the Attorney-in-Fact power to make decisions about the Principal’s medical treatments and general health care. This is usually what is referred to under Delaware state law a ‘Springing’ Power of Attorney Agreement, that only goes into effect when the Principal is declared incapacitated, although it can sometimes be in place upon being signed.

Note that under Delaware state law, all Medical Power of Attorney Agreements (legally known as Advance Health Care Directives) include Living Wills. If the Principal wants the Attorney-in-Fact to abide by any specific End of Life directions, then they must be included in this form in Delaware, as there is no separate form for a Living Will.
