An Idaho Medical Power of Attorney Form is designed to give the Attorney-in-Fact the power to make decisions about the Principal’s medical treatments and health care. This is usually a Springing Agreement, IE a Power of Attorney Agreement that only activates after the Principal is declared incapacitated and is therefore incapable of making decisions for themselves.

Under Idaho state law, a Medical Power of Attorney Agreement is legally known as a Living Will and Durable Power of Attorney for Health Care and, as the official title implies, will always include a Living Will. A Principal should therefore be sure they want their Attorney-in-Fact governing their End of Life care and should spell out their wishes for End of Life care explicitly in the agreement itself, in order to ensure they are honored.
