The New Hampshire Medical Power of Attorney Form is designed to give the Attorney-in-Fact the power to make decisions about the Principal’s medical care. These agreements are almost always Springing, and always Durable, as a Medical Power of Attorney that stopped working after the Principal was incapacitated would be borderline useless.
Under New Hampshire state law a Medical Power of Attorney form will always include a Living Will, with the combined form being legally known as an Advance Directive. Therefore, when drafting a Medical Power of Attorney form, the Principal should choose their Attorney-in-Fact carefully, and make sure their wishes regarding their End of Life care are clear, as their Attorney-in-Fact will also be responsible for seeing them upheld.
