The California sublease agreement may also be structured as a roommate contract depending upon how much space the existing tenant would like to allow for rent. The act of subletting is described as a tenant, or “Sublessor”, who is bound to a fixed lease agreement that decides to re-rent the space they are currently in to someone else, or “Sublessee”. Every rental contract in California must have a clause that states the rules about subletting. If it is not allowed, the tenant will have to get the written permission from the landlord.
