The Massachusetts Commercial Lease Agreement is an agreement prepared to handle a multitude of commercial lease types including industrial, retail, multi-family, and land. The agreement can adjust to specific terms such as a gross lease, net lease, or modified gross lease all within the commercial leasing codes of MA.

A commercial lease for more than one year must be in writing to be enforceable. Included should be a description of the property, an adequacy of statement, and it should state the person in charge of paying utilities.

The following must be included in a Massachusetts Commercial Lease Agreement:

  • A real estate license is required if a person is representing the owner on their behalf (M.G.L. c. 112 § 87 PP)
  • A provision for consideration.
  • Language within the lease that creates a leasehold estate.
