The New Mexico Month to Month Lease Agreement is an agreement that begins and ends every thirty (30) days. This period renews upon rent payment by the tenant. The tenancy has no end date and can only be cancelled or changed by either the tenant or landlord by giving the other party a thirty (30) day written notice.
Unlike most leases, the lack of start or end date makes regular renegotiation of a contract a possibility. This is why the written notice to change the terms of the lease or cancel is important. It is however easier to evict a tenant under a Month to Month Lease Agreement. A notice, allowing thirty days for the tenant to move out is all that’s required. Less time (usually seven days) may be given if rent has not been paid or if the terms of the lease have been violated.
